We have compiled the website’s “Terms and Conditions” to regulate the way products are ordered, sold, delivered as well as the usability of the website. The purpose of which is to:
- Reduce the risk and liability of Furnagent;
- Establish the risk or liability for the user of the website;
- Persuade the user to indemnify Furnagent;
- Advise user to recognise and accept a fact.
It is necessary for all persons who have access or makes use of this website including all those users who register as anticipated below to recognise, understand and comply with these Terms and Conditions. If there is any condition stipulated in the Terms and Conditions that you do not understand, you are obliged to ask Furnagent to provide an explanation before you accept the Terms and Conditions or continue using the website. Please note that by registering as a user on the website you hereby recognise that you have read and accepted these stipulated Terms and Conditions.
Usability of the Website:
You must concede to promptly notify Furnagent as soon as you are aware and suspect any unauthorised infringement or use of your unique username or password and to take measures to alleviate any subsequent loss or harm.
By using the website, you guarantee that you are 18 years old or older and of sound legal capacity. Users under the age of 18 do not have legal authorisation to enter into a binding agreement and you are required to use the website under the supervision of your parent or legal guardian. Transaction of Sale and Availability of Stock:
Furnagent has the power to accept or reject the orders for products placed by users. This depends on whether products are available, the information related to the product is correct (including, not exclusively the price) and the receipt of payment or authorisation of payment by Furnagent for the product.
PLEASE NOTE: Furnagent will only signify the acceptance of your order once the product has been delivered to you, or ready for collection, and only in this event will an agreement of sale between you and Furnagent take place (the “Sale”). This is the case, irrespective of whether a communication from Furnagent stipulated that your order or payment thereof has been confirmed. Furnagent will identify the rejection of your order by cancelling it and will subsequently refund you for the amount already paid.
You must be mindful that the stock of all products is limited, and the pricing thereof may change at any time without announcement. With regards to products offered for sale by Furnagent, Furnagent will do everything in their power to track stock levels and take necessary measures to stipulate on the website when the stock is no longer available, and the offers thereof are discontinued. It is, however, important to note that Furnagent cannot always guarantee the availability of stock. In the event where products are no longer available after the order has been placed, Furnagent will promptly notify you and provide assurance that you are entitled to a refund of the exact amount already paid by you for said product.
Payment Options:
Efforts have been made to ensure that secure online payments facilities are available. We guarantee that all transactions are encrypted with the applicable encryption technology.
All products sold by Furnagent should be purchased via:
- Debit card (with Visa, MasterCard logo and CVV number and expiry date);
- Credit card (VISA, Mastercard etc.): In the event where payment is made via credit card, we may require additional information to enable verification and validation of the payment. In such instances, we have the authority to withhold delivery until we have received the necessary information and obtained authorisation for the required amounts. If such authorisation is not received by us, your order for the products will be cancelled. You are required to guarantee that you are fully authorised to utilise the credit card provided to pay for the products. In addition, you must affirm that your credit card has sufficient funds available to cover all the costs related to the services used on the website;
- Secure Instant Deposit EFT.
Furnagent will under not be able to accept your order if the necessary payment has not been made.
Delivery:
Furnagent has two available methods of delivery on offer. You may select the option of:
- Delivery in and around the Cape Town area is available at an additional charge.
- Courier service is available at an additional charge.
- Users also have the option of self-collection from one of Furnagent stores in Paarl and Brackenfell.
Once you have received confirmation that your order is accepted, Furnagent will begin the necessary procedure to deliver your products as soon as operably possible, with the assurance that it will be no later than 30 days after your receipt of payment (“Delivery period”). We warrant that we will notify you in the event where delivery of the products during the delivery period cannot take place. You are subsequently permitted to decide whether you would like to cancel your order of the products, within seven days of receiving such notification. If you choose to cancel your order under these stipulated circumstances, you will be reimbursed the full amount paid by you.
It must be emphasised that users must ensure they have enclosed the correct physical address.
Furnagent shall not be responsible for any loss, damage or unlawful use of a product after a product has been delivered to your designated physical address.
Errors:
We shall do our utmost best to ensure that information regarding the description, availability, purchase price and delivery charges of products are accurately displayed on the website. However, it is important to note that should there be any errors of any kind on the website (which are not related to gross negligence on our part), we shall not be held accountable for any loss, claim or expense incurred as a consequence of a transaction based on an error, with the exception that the purchase price was incorrect – to the extent that we are obliged to refund you for any amount already paid, as outlined in the Returns Policy.
